Constellation Energy initiates sampling of residential wells, based on trends observed in monitoring wells on the fill site, and identifies a small number of wells with metals at levels slightly above EPA's primary drinking water standard. Constellation Energy notifies regulators, initiates an investigation, and begins distribution of bottled water. Anne Arundel County Health Department conducts its own tests of wells in the area. Constellation Energy begins work with MDE to develop additional site controls, evaluation and corrective action. |

Constellation Energy files with MDE the results of groundwater evaluation and recommendations for improving site conditions. Constellation Energy submits to the Maryland Department of the Environment an “Alternatives Analysis and Proposed Remediation Report” for site compliance with the Consent Agreement. External “Community Ash Update” web site launched which includes information such as updates on consent decree filings, information on what coal ash is and how it’s handled, and a question and answer section. Constellation Energy meets with the Anne Arundel County Health Department to review Alternatives Analysis. |

Constellation Energy meets with additional state and local officials to review Alternatives Analysis. Site survey completed. Survey designed to delineate ash boundaries for use in land record filings, to provide a long-term record of the location of the ash. |

Public presentation and Q&A on groundwater modeling results and Remedial Alternatives Analysis presented to interested members of the community. MDE and Constellation Energy meet to discuss submittal and answer questions on groundwater modeling associated with this evaluation. |

Site activities continue. These include: stabilization, follow-up inspections, groundwater monitoring, operation and maintenance of the active groundwater remediation system (installed in 2004), and engineering for the public water system. |
April 2009: |
Constellation Energy submits annual trend analysis to MDE, summarizing and interpreting groundwater monitoring data collected regularly. Trend analysis explains that sulfate and other constituents most pertinent to the ash (boron, chloride and lithium) in the groundwater were showing a general trend of decreasing in concentration. The report also summarizes that groundwater extraction wells near Turner Pit have been demonstrated to be effective to capture (in other words prevent further migration) of groundwater. |
May 2009: |
Constellation Energy meets with MDE to: 1) Provide an overview of progress to stabilize and close the site and install public water; 2) Discuss the groundwater monitoring methodology, results and trends; and 3) Seek feedback on plans submitted for MDE approval |

Constellation Energy follows up on meeting comments (expressing a preference for analysis of “total” rather than “dissolved” metals). Constellation confirms by email to MDE that it would commence analysis for dissolved metals with the July sampling event. |

MDE approves Constellation Energy’s requested water appropriation permit modification, which authorizes increased extraction of groundwater. Permit is a prerequisite to the installation of a sixth recovery well in the vicinity of Waugh Chapel Road (to enhance the five-well groundwater recovery and treatment system installed in 2004) |
Dec. 2009: |
MDE submits comments to Constellation Energy regarding its “Alternatives Analysis and Proposed Remediation Report” and the underlying groundwater modeling. Feedback from MDE includes partial approval with requests for additional information, studies and some re-submittals. MDE approves the Declaration of Restrictive Covenants (Consent Decree Paragraph 56) and the Voluntary Well Replacement or Treatment Offer Plan (Consent Decree Paragraph 43) and adjustments to the Groundwater Monitoring Plan. |
